1. Information of the User/Visitor :- Information that may be submitted over the website

The website may be viewed while browsing anonymously. The user/visitor may submit personal information for various reasons, including but not limited to, filling up the request form for expressing interest in any of the designs displayed on the website, for the purpose of obtaining newsletters, product information, events information, services, or to answer surveys, enter contests and receive information on promotional offers. The type of personal information that may be submitted may include name, address, e-mail address, contact number, birth-date, purchase information, debit or credit card details. Such information may be used to create a database and/or a customer profile. The Owner may also combine the information so submitted, with other data that is collected offline about users to mould marketing or website content or for other purposes such as internal research, etc.

2. Information that may be collected by the website

The website may also collect aggregate, general and non-personal information of a user/visitor. Such information would not relate to a single identifiable user/visitor. It may be for the sake of computing the number of visits on the website or any part thereof, determining the popularity of a webpage, etc.

The information collected under clause 1 of the Privacy Policy would not be shared with entities unaffiliated to the Owner unless,

• Required to do so under the applicable law for the time being in force or under legal process;
• Required to do so by law enforcement authorities or Government Officials;
• The Owner believes that the same is necessary for preventing any form of harm, damage or injury to the rights or property of the Owner or the Designers Shyamal & Bhumika or interference with Owner’s or Designers’ enjoyment of the same.
• Required to do so in connection with the investigation of any suspected illegal activity;
• The Owner has a reason to believe that the user/visitor has used the information from the website in order to commit unlawful acts or acts that may endanger public health, safety and/or order;
• The Owner believes that law in good faith requires such disclosure.

The user/visitor may choose to unsubscribe from marketing emails by sending an email to sales@shyamalbhumika.com or by clicking on the unsubscribe link that may be provided. The personal information already submitted may be updated or modified by sending an email to sales@shyamalbhumika.com. In the course of unsubscribing or modifying information, the Owner may share information with other entities whenever necessary for carrying out the request of the user/visitor.

5. Unsolicited information and/or data

The user/visitor is requested not to send in unsolicited information and/or data over the website. The Owner does not take any responsibility for such unsolicited material supplied by the user/visitor and the same shall not be subject to this Privacy Policy.

The user/visitor understands and agrees that unsolicited material provided by him/her, shall be utilized by the Owner in any manner they deem fit and the same shall be provided to the Owner automatically under a perpetual and royalty-free license.

If the unsolicited material provided contains material protected by third-party copyright, trademark or other proprietary rights, the user/visitor shall indemnify the Owner for any claim, damage, injury, cost or loss arising to the Owner from the use of possession thereof.

6. Security

Reasonable precautions are taken for protecting the information of the user/visitor collected under Clause 1. However, transmission and storage over the Internet are not completely secure and accurate. No guarantee is given for the security of the transmission and storage of content on the website or the databases of the website or other services. It cannot be guaranteed that the information that is collected under Clause 1 will not be intercepted in the course of transmission or storage. The Owner would not be responsible for the unauthorized actions of third-parties.

7. Management/control

In the event of any merger, acquisition or sale of the business of the Owner or Designers Shyamal & Bhumika, or the unlikely event of insolvency or bankruptcy, the information collected over the website may also be transferred to another entity.

8. Children’s privacy

The website is not intended for children and no information is intentionally collected from such children under the age of 13 years. 9. Privacy rights under other Jurisdictions

The user/visitor shall not be entitled to receive the details of his/her information collected under Clause 1, and shared or stored or used by the Owner unless the Owner is required to do so under applicable law or legal process. In case, the Owner is required to do so under applicable law or legal process, request for the details of such information may be sent to sales@shyamalbhumika.com. The Request shall be verified and if found genuine and legal, it shall be responded to within 45 working days.
